These Terms of Service ("Terms") govern your use of the Kinya app and kinya.io website (together, the "Service"), operated by Kinya. By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Kinya. By using the Service, you confirm you meet this requirement.
2. Your Account
Kinya uses Sign in with Apple to create and secure your account. You're responsible for keeping your Apple ID secure — anyone with access to it can access your Kinya account. If you suspect unauthorized access, contact us immediately at hi@kinya.io.
3. The Service
Kinya lets you track birthdays and other occasions for the people in your life, store notes and gift ideas, and receive AI-generated gift suggestions with links to purchase them from third-party retailers. Kinya is currently free to use. If we introduce paid features in the future, we'll clearly disclose pricing before you're charged, in compliance with Apple App Store and Google Play billing requirements.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except where permitted by law
- Use automated systems (bots, scrapers) to access the Service
- Upload content that is unlawful, harassing, or infringes someone else's rights
5. Your Content
You retain ownership of the information you enter into Kinya (names, notes, gift ideas, and photos). By adding it, you grant us a limited license to store, process, and display it back to you as part of operating the Service — including sending it to our AI provider to generate gift suggestions, as described in our Privacy Policy. We don't use your content for any purpose beyond operating and improving the Service.
You're responsible for having the right to store information about other people (such as friends or family) in Kinya. Kinya is intended for personal, non-commercial use to help you remember occasions for people you know.
6. AI-Generated Suggestions
Gift suggestions are generated by an AI model based on the information you provide. We don't guarantee that suggestions will be accurate, available, appropriate, or in stock at the linked retailer. Prices, availability, and product details shown in the app may not reflect real-time information from Amazon, PriceRunner, or other retailers — always confirm details on the retailer's own site before purchasing.
7. Affiliate Links & Third-Party Purchases
Kinya includes links to products on third-party retailers, including Amazon and PriceRunner. When you make a purchase through these links, you are buying directly from that retailer, not from Kinya. Your purchase is governed entirely by that retailer's own terms, return policies, and privacy practices — Kinya has no involvement in, and no responsibility for, the transaction, product quality, shipping, or customer service.
As disclosed in our Privacy Policy, we may earn a commission on qualifying purchases made through these links, at no extra cost to you. This financial relationship does not influence which products the AI suggests based on your stated budget and interests.
8. Intellectual Property
The Kinya name, logo, and app design are owned by us. Except for the license you grant us over your own content (Section 5), nothing in these Terms transfers any Kinya intellectual property to you.
9. Termination
You may stop using Kinya and delete your account at any time by contacting hi@kinya.io. We may suspend or terminate your access if you violate these Terms, or discontinue the Service (or features of it) with reasonable notice where possible.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI suggestions will meet your expectations.
11. Limitation of Liability
To the maximum extent permitted by law, Kinya and its operators will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any losses related to purchases made through affiliate links. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll notify you in the app or by email before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of Denmark, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.
